Risk Disclosure Statement
Please read this carefully before using the Service
Exchanging cryptocurrency is high-risk. You may lose some or all of the value involved. By creating an exchange request or otherwise using the Service, you confirm that you understand and accept every risk described below. If you do not understand or accept these risks, do not use the Service.
This Risk Disclosure Statement forms part of, and should be read together with, our Terms of Use, Privacy Policy, and AML/KYC Policy. It is not exhaustive and does not, and cannot, describe every risk associated with digital assets.
1. High-risk nature of digital assets
Cryptocurrencies and other digital assets are a novel, complex, and insufficiently tested technology. Their value can fall as well as rise, and can become zero. They are not backed by any government or central bank and are not covered by any deposit-protection or investor-compensation scheme. You should never exchange more than you can afford to lose.
2. Market and price volatility
Digital-asset prices are highly volatile and can change significantly within seconds, including between the moment you create a request and the moment the exchange is completed. Rates shown on the website are indicative estimates only. The final rate is confirmed by a manager at the time of processing and may differ from any estimate shown.
3. Irreversibility of blockchain transactions
Blockchain transactions are final and cannot be reversed, cancelled, or recovered. You are solely responsible for providing the correct receiving wallet address and the correct network. Sending to an incorrect, incompatible, or unsupported address or network will result in the permanent loss of your assets, for which we are not liable.
4. No custody and no recovery
We do not hold customer balances, operate customer accounts, or store customers’ private keys. We cannot freeze, reverse, or recover assets once they have left a wallet. Safeguarding your own wallets, devices, and credentials is entirely your responsibility.
5. Rates, margin, fees, and limits
The price you receive includes our service margin (currently 3% above the reference market rate) and may be affected by network (blockchain) fees, liquidity, and the timing of your transaction. Minimum and maximum limits apply and may change at any time. A quoted or displayed estimate does not guarantee execution at that rate.
6. Manual, request-based process
The Service is not an automated or instant exchange. Each request is reviewed and completed manually by a manager after the required checks. Completion times are not guaranteed and depend on verification, network confirmations, liquidity, and manager availability.
7. Availability and liquidity
Specific exchange directions may be unavailable, delayed, suspended, or subject to reduced limits at any time, without notice. We may modify, suspend, or discontinue all or part of the Service at any time.
8. Regulatory and legal risk
The legal and regulatory status of digital assets is uncertain and varies by jurisdiction, and may change rapidly and without notice. It is your responsibility to ensure that your use of the Service is lawful in your jurisdiction. The Service is not available in Restricted Jurisdictions (see the Terms of Use), and you must not attempt to circumvent those restrictions.
9. Compliance, verification, and holds
Identity verification is mandatory. Transactions may be delayed, placed on hold, refused, or returned where required by our verification, sanctions/PEP screening, or wallet risk-screening procedures, or by applicable law. Where a transaction cannot be completed, any assets already received may be returned in accordance with our procedures, less unavoidable network fees, subject to applicable law.
10. Third-party dependencies
The Service relies on third parties we do not control, including Telegram, market-data providers, blockchain networks, and identity-verification and blockchain-analytics providers. We are not responsible for their availability, accuracy, actions, or omissions. Communications via Telegram are also subject to Telegram’s own policies.
11. Technology and security risk
Software, websites, and blockchain networks can contain errors or experience downtime, congestion, forks, or attacks. Digital assets are a frequent target of hacking, phishing, and fraud. We cannot guarantee that the Service will be uninterrupted, secure, or error-free.
Beware of impersonation and scams. We will only ever contact you through our official Telegram manager account published on the website (@simplecryptoswap). We will never ask for your seed phrase or private keys, never send you unsolicited messages first asking for funds, and never guarantee profit. Anyone who does is a scammer.
12. Privacy-coin and network-specific risk
Certain assets and networks carry additional risk, including privacy coins and any asset subject to enhanced screening, delisting, or reduced support by wallets, networks, or compliance providers. Support for any asset or network may be limited or withdrawn at any time.
13. Tax
You are solely responsible for determining, reporting, and paying any taxes applicable to your transactions. We do not provide tax advice.
14. No advice
We are not your broker, agent, fiduciary, or advisor. Nothing on the Service or communicated by us constitutes investment, financial, legal, or tax advice. You are solely responsible for your decisions and should seek independent professional advice where appropriate.
ACKNOWLEDGEMENT. BY USING THE SERVICE YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS RISK DISCLOSURE STATEMENT, THAT DIGITAL-ASSET EXCHANGE CARRIES SUBSTANTIAL RISK, THAT YOU MAY LOSE SOME OR ALL OF THE VALUE INVOLVED, AND THAT YOU ACCEPT ALL SUCH RISKS. THERE MAY ALSO BE OTHER RISKS THAT WE CANNOT ANTICIPATE.
